MormonLeaks submitted GRAMA request to BYUPD and were denied

Post by _Shinster »

From MormonLeaks's Facebook wall:

"We submitted a GRAMA request (Utah's FOIA equivalent) to the BYU Police Department for an audio recording of their detectives' interview with Joseph Bishop in December 2017. It was denied claiming they are not a government organization and that it would breach Bishop's privacy. We have appealed to the State Records Committee and have been granted a hearing date of June 14. Below is a copy of our communications with BYUPD and the State Records Committee."

Consiglieri, have you heard back from BYUPD? Thoughts about this?

Did BYUPD just ignore this: "Judge rules BYU police is a government entity in regard to public record requests"?

MormonLeaks wants the audio of the Detectives interview with Bishop. Will they get it, who knows. But the contents of that interview will be known in time, especially by McKenna Denson and her attorney. Her attorney can subpoena the Detectives who did the interview and their notes, and question them for days at the civil trial deposition, or put them on the stand for a week if it goes to trial. The best thing about police reports is not the content but the names of the people involved in the report, including those who took it, who can be put on the witness stand and questioned. This way, the contents eventually get admitted into the record via the Detectives testimony.

The legal system in Utah is rigged to favor the Church. Only an appeal to a federal court in Denver could provide an opportunity for an impartial judgment.

BYUPD would be more immune to revealing any information if they would get out of the police department biz and declare themselves to be a covert paramilitary organization.
